The application can be brought – Before issuing the divorce summons; Together with the issuing of the summons; or After the Notice of Intention to Defend is received from the Defendant in the divorce proceedings. The application consists of a Notice of Motion and a Founding Affidavit setting out the relief prayed for by the party seeking the Interim Order (the Applicant). The Applicant needs to set out the facts relating to the divorce as well as why he/she is entitled to relief from the other party (the Respondent). The Applicant should also make full financial disclosure of his/her financial position and set out the funds required for the contribution towards legal costs or interim maintenance. The application will be served on the Respondent and lodged at Court. The Respondent will be granted an opportunity to respond to the Application by filing an opposing affidavit within 10 days of receipt of the application. The Respondent may also bring a counter application, for example requesting interim access to or custody of the minor child/children.
